Cannabis plant

The Regulation No. 455/2009 Coll. defines for the purposes of § 285 of the Criminal Code cannabis plants containing a narcotic or psychotropic substance as such species and varieties of cannabis which contain more than 0.3% THC. An amount 'larger than small' then means more than 5 such cannabis plants.

§ 1 - Cannabis plants containing a narcotic or psychotropic substance within the meaning of § 285 of the Criminal Code

For the purposes of § 285 of the Criminal Code, cannabis plants containing a narcotic or psychotropic substance under Annex 1 to this Regulation shall mean such species and varieties of Cannabis which contain more than 0.3% of tetrahydrocannabinols in the flowering tops or buds of the cannabis plant (except seeds), including leaves.

§ 2 - Specification of an amount larger than small in respect of cannabis plants containing a narcotic or psychotropic substance within the meaning of § 285 of the Criminal Code

Pursuant to Annex 2 to this Regulation, an amount larger than small in respect of cannabis plants containing a narcotic or psychotropic substance within the meaning of § 285 of the Criminal Code shall mean more than 5 cannabis plants.
