Testing of the presence of addictive substance

§ 16 – Testing of the presence of alcohol or other addictive substances

 

(1) Individuals engaged in an activity that could endanger their own life or health, or the life or health of others, or damage property must not consume alcoholic beverages or use other addictive substances while or before carrying out such activity.

 

(2) Individuals about whom there is a reasonable suspicion that they are under the influence of alcohol while carrying out activities pursuant to paragraph 1, as well as individuals about whom there is a reasonable suspicion that they have caused injury to the health of someone else in connection with the consumption of alcoholic beverages, are required to submit to an indicative and specialized medical examination to determine their blood alcohol content. If the examination of the blood alcohol content of the individual is carried out using a breathalyzer test, as per the conditions in a special legal regulation, a specialized medical examination shall not be required. If the individual refuses this type of indicative testing, a specialized medical examination shall be performed.

 

(3) Individuals about whom there is a reasonable suspicion that they are under the influence of an addictive substance other than alcohol while carrying out activities pursuant to paragraph 1, as well as individuals about whom there is a reasonable suspicion that they have caused injury to the health of someone else in connection with the consumption of some other addictive substance, are required to submit to an indicative examination and a specialized medical examination to determine the content of such other addictive substance.

 

(4) Persons authorized to require an individual under paragraphs (1) through (3) to submit to an examination in accordance with paragraphs (2) and (3) include officers of the Police of the Czech Republic, Military Police, Prison Service of the Czech Republic, the individual´s employer, attending physician, municipal police officers or by persons responsible for the supervision of individuals engaged in an activity that could endanger their own life or health or the life or health of others or damage property.

 

(5) Indicative examinations are performed by units of the Police of the Czech Republic, units of the Military Police, Prison Service of the Czech Republic, persons responsible for the supervision of individuals engaged in an activity that could endanger their own life or health or the life or health of others or damage property, the individual´s employer, attending physician or municipal police officers. Specialized medical examinations are performed by a qualified health services provider with specialized medical equipment. If an individual under paragraphs (1) through (3) refuses to consent to an examination pursuant to paragraphs (2) and (3), he/she will be regarded as under the influence of alcohol or other addictive substances.

 

(6) The qualified health services provider with specialized medical equipment shall provide the necessary assistance to entities referred to in paragraph (4) by taking samples of biological materials.

 

(7) The health services provider shall disclose the results of the examination to entities under paragraph (4) at their request. This does not apply if the patient is examined for the presence of alcohol or other addictive substances in the body solely in the context of health care provided for the purposes of a differential diagnosis.

 

(8) If the specialized medical examination demonstrates the presence of alcohol or an addictive substance other than alcohol, the costs of examination of the biological material and transportation to the medical facility to perform the specialized medical examination shall be borne by the person examined. If no alcohol or other addictive substance is detected, the costs incurred in accordance with the first sentence of this paragraph will be borne by the person referred to in paragraph (4) who requested the examination, except in cases of differential diagnosis covered by public health insurance under a special legal regulation

 

(9) The person requesting the examination pursuant to paragraph (4) is responsible for transporting the individual to the medical facility.
